Probate Assistance in Carshalton
Probate does not have to be confusing. I break the process down into clear, manageable steps and handle every one of them for you. Carshalton families get personal service, fixed fees, and an experienced specialist who does the work, not delegates it.
Probate, Step by Step
Somebody dies. Their estate (everything they owned) needs to be dealt with.
You need authority to act. The court issues a document called a grant of probate (if there is a will) or letters of administration (if there is not). Without this, banks and other institutions will not release the deceased's money or assets.
You apply to the court. This means filling in the probate application, which requires a detailed understanding of the estate. You also need to submit inheritance tax forms to HMRC, even if no tax is due.
You collect the assets. Once you have the grant, you write to every bank, pension provider, insurer, and investment manager to collect what the deceased owned.
You pay the debts. Any outstanding debts, including taxes, are paid from the estate.
You distribute what remains. The beneficiaries receive their inheritance according to the will (or the rules of intestacy if there is no will).
You prepare the accounts. Final estate accounts show every transaction and confirm that everything has been distributed correctly.
That is probate. It is not complicated in principle, but it is time-consuming, detail-heavy, and carries real legal consequences if anything goes wrong.
I handle all of it for Carshalton families. Every step, every form, every phone call.
When Professional Help Makes Sense
But for most Carshalton families, the estate is not simple. There is a property to deal with. There may be inheritance tax to calculate. There are multiple financial institutions to contact. There is a timeline to manage, and HMRC to satisfy.
Professional probate assistance makes sense when:
- The estate includes property (which almost always requires the grant before it can be sold).
- Inheritance tax may be due.
- There are multiple bank accounts, pensions, or investments.
- You are not confident dealing with HMRC.
- There is no will.
- Family dynamics are complicated.
- You want to make sure everything is done correctly and you are protected as executor.
Let Me Take This Off Your Plate
I have helped hundreds of Carshalton families through this. I know what needs to happen, when it needs to happen, and how to make it happen efficiently. My job is to handle the administration so you can focus on your family.
Fixed Fees, No Surprises
Fixed fees from £1,880
- I provide a specific fixed-fee quote after our initial consultation. The fee covers the full estate administration from application to distribution.
- Disbursements (court fees, statutory notices, and other third-party costs) are separate and will be itemised before you agree to proceed.
- I do not bill hourly. The fee I quote is the fee you pay. If the estate turns out to be more complicated than expected, that is my problem, not yours.
- Timeline: Simple estates can be administered in a few months. Estates involving property sales or inheritance tax take longer. I give you an honest timeline at the start and update you as things progress.

Frequently Asked Questions
How long does probate actually take from start to finish?
It depends on the estate. A straightforward estate with no property to sell and no inheritance tax due can be completed in three to four months. An estate involving a property sale, inheritance tax, or complications (such as missing beneficiaries or disputes) can take six months to a year, sometimes longer. I give you a realistic estimate at the outset based on the specific circumstances of the estate. Two government departments, HMRC and the Probate Registry, are involved, and their processing times are outside my control. What I can control is how quickly and accurately I prepare and submit everything, and I do that as efficiently as possible.
What is (the grant of) probate?
A grant of probate is an official document issued by the courts that gives you the authority to manage the financial and legal affairs of someone who has died.
Here’s how it works:
- If the deceased left a will, the people named as executors apply to the court for this permission.
- The grant is typically a single sheet of paper confirming the executors and giving them the power to administer the estate.
- If there is no will, the court issues ‘letters of administration’.
Without a grant of probate no one has the authority to deal with the deceased’s financial matters, property, or assets.
How much does probate cost?
In our discussion I would provide a fixed-fee quote.
Do I always need probate?
You need probate if:
- The deceased held assets in their name
- Financial institutions request it
- There are complex assets or debts
Can I do probate myself?
While possible, DIY probate carries significant risks. One mistake can cost thousands in penalties or delays. Professional assistance typically saves money and stress.
How long does probate take?
Managing an estate and distributing assets to the beneficiaries involves dealing with two government departments – first HMRC and the Court Service – each of those may last a few weeks to several months. And then there’s the disposal of assets, if there’s a house in the estate, well we know how long it can take to sell a house.
What is the Estate?
A person’s estate is every object, or contract that was in the name of the deceased, these include:
- The deceased’s principal private residence,
- other land and buildings,
- cash, shares and similar assets,
- pensions
- life insurance
- business interests
- things you’ve given away in the last seven years
Will I pay inheritance tax?
Whether you pay inheritance tax depends on:
- The value and nature of the assets in the estate
- The identity of the beneficiaries
Inheritance tax is not paid by everyone. It is only due if the estate exceeds a certain threshold (called the “nil-rate band”), and certain exemptions or reliefs may apply, such as spouses inheriting or charitable donations. The responsibility to pay the tax falls on the estate itself, meaning the executor must ensure the tax is paid before distributing assets to beneficiaries.
Who pays estate debts?
Debts are paid out of the deceased’s estate. Relatives do not have to pay for them out of their own pockets.
The estate is bound to make every effort to identify the deceased’s debts. It is only after debts have been met that assets may be distributed.
What if there’s no will?
Without a will (intestacy), assets are distributed according to strict legal rules. Spouses, children, parents, and siblings inherit in specific order. I guide families through these rules.
Can a will be challenged?
Yes, but I support you in defending against or resolving disputes.
Funeral expenses
The funeral is a contract between the person who walked into the funeral directors shop and the funeral director. It has nothing to do with the deceased. Nonetheless, banks and building societies generally meet the funeral expenses out of the deceased’s bank account [if there is cash in the account] .
